Sales conditions

This purchase is governed by the below standard sales conditions for consumer purchases of goods over the Internet. By consumer purchase here is meant the sale of goods to a consumer who does not mainly act as part of a commercial activity, and when the seller acts in a commercial activity by selling goods over the internet.

1. General
‍ This online store is operated by Palmesus AS.

These sales conditions apply to all sales of goods from Palmesus AS, sold through the webshop. The terms of sale together with your order, confirmed through an order confirmation, constitute the overall contractual basis for the purchase. The sales conditions and other information for the online store are only available in Norwegian.

We only deliver to addresses in Norway. Consumer purchases are regulated in, among other things, the Consumer Purchases Act, the Right of Cancellation Act, the Marketing Act, the Personal Data Act, the E-commerce Act and the Credit Purchases Act. Where these conditions of sale require written conditions, this is fulfilled by the use of e-mail or

‍ The seller is: Palmesus AS, Østerveien 6, 4631 Kristiansand S, registered in the Brønnøysund register with corporate no.: NO 916 867 921 VAT and will be referred to in the following as "we" or "us". Buyer is: the person stated as the buyer in the order, and is hereinafter referred to as "you", "you", "your" or "your".

3. Prices

All prices in the online shop include VAT, but exclude shipping. We reserve the right to change prices without prior notice. The prices are stated in Norwegian kroner. It is always the current price at the time of the order that is the current price. Price changes afterwards do not affect sent orders.
We reserve the right to price errors, but cannot, on the other hand, change the price of an item for which you have had a price confirmed, with the exception of cases where serious, obvious errors have occurred.
We will at all times provide the best possible description of the products that are available for sale. If a product does not correspond to the specifications provided by us, it does not in itself entitle the buyer to any claim against Palmesus AS. It also does not give the right to return the product, provided that the specifications of the product delivered do not deviate significantly from those stated.

4. Order and agreement process
Your order is binding when the order is registered in our system. Palmesus AS is also bound by your order if it does not deviate from what is offered by us in our online shop, our marketing or in any other way. You still have the right to withdraw from the purchase in accordance with the Act on the right of withdrawal if you are a consumer (see point 11). When Palmesus AS receives your order, we will confirm the order and automatically send you an order confirmation. Read the order confirmation carefully when you receive it and check whether the order confirmation is in accordance with the order. Deviations between your order and the order confirmation are considered a new offer from us, which you can accept or decline. You still have the right to make your original order valid if it is in accordance with what we have offered. Exceptions may occur.

5. Information provided in the online store
Palmesus AS strives to give our customers as correct information about our products as possible. We reserve the right, however, that image/typing/printing errors may occur, which may mean that we cannot deliver according to information provided in our online store, our marketing or otherwise. Furthermore, we reserve the right to cancel your order or part of it, if the product is sold out. In the case of sold-out situations, you will be notified of this, possibly together with information about what we can offer instead. You will have the option to accept our new offer with the changes we specify in relation to your order, or cancel the order.

6. Payment
The purchase price is settled through the payment options offered in the online store.


7. Delivery and delay
Delivery of the products takes place in the manner, at the place and at the time indicated on the order confirmation. We bear the risk for the products until they are taken over by you, i.e. when you have received the products in your possession. If the delivery of the products is delayed, we will give you information as soon as we are aware of it, together with information about and possibly when delivery may be, or whether the product(s) are sold out.


8. Examination of the products
After you have received the products, you should, as soon as you have the opportunity to do so, check whether the delivery is in accordance with the order confirmation, whether the products have been damaged during transport, or whether the products otherwise have faults or deficiencies.

9. Your rights in the event of errors and omissions (Complaint)
‍ If the products are faulty or missing, you can, depending on the circumstances, demand correction of the fault, redelivery, price reduction, compensation or cancellation of the purchase. The error must be present when you receive the products in your possession. Faults that you discover within six months of receiving the products, however, should normally be regarded as faults that occurred before you received the products. Notification of errors and defects in the products can be given to us orally or in writing. This must take place within a reasonable time after you discovered or should have discovered the error or deficiency. However, you always have at least a two-month complaint period from when you discovered the fault if it is a consumer purchase. For reasons of proof, we recommend that the complaint be sent to us in writing. We will confirm receipt of all complaints in writing. The right to advertise applies for two years after you have taken over the product, or five years if the product is intended to last significantly more than two years. The right to complaint is in addition to the right to cancel.

10. Warranty
Our guarantees do not imply any restrictions on the complaint period for goods according to the Consumer Purchase Act or according to the Purchase Act if it is not a consumer purchase. The complaint deadline is two years after you took over the item, or five years if it is a consumer purchase and the item is intended to last significantly more than two years.

11. Right of withdrawal for consumer purchases
The Right of Cancellation Act gives you the right to cancel your purchase if you are a consumer (consumer: natural person who does not mainly act as part of a commercial activity). The right of withdrawal applies to goods and to certain services (see exceptions in the third section). The right of withdrawal requires that you notify us of this no later than 14 days after you receive the delivery (withdrawal period). If you have not received a right of withdrawal form either in the order confirmation or upon delivery of the products, this period is extended to three months. In order for the right of withdrawal to be exercised, the product must be delivered to us in approximately the same quantity and condition as you received it, free of dirt and smell. The products must not have been used as your own. All products must be returned to us within a reasonable time. Any return shipping must be paid for by you. We bear the risk of the transport back to us when using our return label. We are obliged to repay you what you have paid including postage for the shipment to you, handling fees, customs fees, collection fees, etc. Repayment must take place within fourteen days after we receive the product from you or a collection note or the product is made available for us.

The product is sent back to us including the original packaging, labels, hangtags etc. If the original packaging is damaged, the item will be considered used.

The product cannot be used and must be returned complete with packaging and tags.

12. Unclaimed packages
The carrier sends out a notification about the package's arrival as soon as it arrives at your nearest delivery point. Then, after 7 days, a reminder about unclaimed packages will be sent out. If the package is not picked up, it will be returned to us.
If you do not collect the package and are otherwise completely passive, this will not give us any indication as to why the package has not been collected. You will then not have met the requirements set for you in accordance with §11 and §13 of the Withdrawal Act, and thus lose the right to withdraw from the agreement. You will then be charged a fee of NOK 300 to Palmesus AS. This covers picking, dispatch, return shipping, return and processing of the item. You will receive a separate invoice with this fee.

13. Sales pledge

Palmesus AS has a sales lien on the delivered products until the purchase price, including interest and costs, has been paid in full.

14. Personal data
To make a purchase with us, we need your name, address, mobile number and email.
This is necessary in order to be able to send your order to the correct delivery address, keep you up to date with order movements and contact you should there be a need according to your orders. We are required to store order information in connection with accounting, tax handling and any warranty/return handling. This history is deleted after ten years.
